1. Introduction and Acceptance of Terms
Welcome to Amigo Treks and Expedition Pvt. Ltd., a government-licensed trekking and travel company based in Amrit Marg, Thamel, Kathmandu, Nepal. We specialize in organizing treks, tours, and travel experiences across Nepal, Tibet, Bhutan, and India.
By accessing our website, making an inquiry, or booking any trip, service, or package with us, you (“Client,” “Traveler,” or “you”) acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions, along with any additional policies referenced herein (including booking, cancellation, and privacy policies).
These Terms and Conditions apply to all services provided by Amigo Treks and Expedition Pvt. Ltd. (“Company,” “we,” “us,” or “our”), including, but not limited to trekking packages, guided tours, adventure activities, transportation, and other travel-related services.
Your acceptance of these Terms becomes effective upon any of the following actions:
Confirming a booking with us (via email, website, phone, or in person)
Paying a deposit or full trip cost
Participating in any trip or service organized by the Company
If you do not agree with any part of these Terms and Conditions, you must refrain from using our services or proceeding with any booking.
The Company reserves the right to update, modify, or revise these Terms and Conditions at any time to reflect operational, legal, or regulatory changes. The latest version will always be published on our official website, and it is your responsibility to review them prior to confirming your booking.
By proceeding with your booking, you confirm that you are at least 18 years of age, or that you are booking under the supervision and consent of a parent or legal guardian, and that you have the legal authority to enter into this agreement.
These Terms and Conditions are governed by the laws of Nepal, and any disputes arising in connection with our services shall be subject to the jurisdiction of the courts of Kathmandu, Nepal.
2. Definitions
For the purpose of these “Terms and Conditions”, the following words and expressions shall have the meanings set out below. These definitions apply to all bookings, treks, tours, and travel services organized by Amigo Treks and Expedition Pvt. Ltd.
“Company,” “We,” “Us,” or “Our” refers to Amigo Treks and Expedition Pvt. Ltd., a government-licensed trekking and travel company based in Amrit Marg, Thamel, Kathmandu, Nepal, operating trips in Nepal, Tibet, Bhutan, and India.
“Client,” “Traveler,” “Customer,” or “You” refers to any individual or group who books, intends to book, or participates in any trip, tour, trek, or service offered by the Company.
“Trip,” “Tour,” “Trek” or “Activity” refers to any itinerary, package, or travel/adventure/wellness experience organized, operated, or facilitated by the Company, including but not limited to trekking, hiking, sightseeing tours, cultural and wellness experiences, and adventure activities.
“Services” refers to all arrangements and provisions made by the Company in relation to a Trip, including guides, porters, transportation, accommodation, meals, permits, logistics, and any additional services as outlined in the confirmed itinerary.
“Booking” refers to the act of reserving a Trip or Service with the Company, whether made via the website, email, phone, or in person, and confirmed upon receipt of deposit or full payment.
“Itinerary” refers to the detailed plan of a Trip, including schedule, destinations, inclusions, and activities, which may be subject to reasonable changes due to operational or external factors.
“Guide” refers to a licensed and trained individual contracted by the Company to lead, assist, and support Clients during a Trip.
“Porter” refers to an individual engaged by the Company to carry luggage and equipment during trekking or expedition activities.
“Force Majeure” refers to any event beyond the reasonable control of the Company, including but not limited to natural disasters, extreme weather conditions, political instability, strikes, pandemics, flight cancellations, government restrictions, or any unforeseen circumstances that may affect the operation of a Trip.
“Third-Party Providers” refers to external service providers engaged by the Company, such as airlines, hotels, transportation companies, or local operators, whose services form part of the Trip.
“Deposit” refers to the advance payment required to confirm a Booking, as specified by the Company.
“Balance Payment” refers to the remaining amount payable by the Client prior to the commencement of the Trip.
“Cancellation” refers to the termination of a Booking by the Client or the Company, subject to applicable cancellation policies and charges.
“Website” refers to the official online platform of Amigo Treks and Expedition Pvt. Ltd., where information about Trips and Services is published.
These definitions are intended to clarify key terms used throughout these Terms and Conditions and shall be interpreted consistently in all related documents and agreements.
3. Scope of Services
Amigo Treks and Expedition Pvt. Ltd. offers a comprehensive range of trekking, tour, trip, adventure, and wellness packages across Nepal, Tibet, Bhutan, and India.
Our services are designed to deliver safe, well-organized, and meaningful travel experiences, combining adventure, culture, and comfort.
3.1 Description of Package
Our packages include guided short and long treks, peak climbing, cultural tours, leisure trips, adventure activities (such as mountain flight, paragliding, rafting, ultralight flight, zip lining, bungy jumping, rock climbing, horse riding and other outdoor experiences), and wellness journeys that may include yoga, meditation, sound healing, chakra opening and relaxation programs. We also provide luxury lodge treks and fully customized itineraries tailored to individual preferences, timeframes, and fitness levels.
Each package is supported by a detailed itinerary outlining daily schedules, destinations, elevation (where applicable), accommodation standards, included activities, and key highlights.
Our operations cover popular regions such as Everest, Annapurna, Langtang, Manaslu, Kanchenjunga, Makalu, Kathmandu, Pokhara, Chitwan, Bardiya, Janakpur etc. in Nepal, and all popular regions in Bhutan, India and Tibet as well as off-the-beaten-path destinations in these countries.
All trips are conducted with the support of experienced, licensed guides and trained staff, ensuring safety, proper coordination, and authentic local experiences. While we aim to follow the confirmed itinerary, all services remain subject to reasonable modifications due to weather conditions, health and safety considerations, local regulations, or other unforeseen circumstances beyond the Company’s control.
3.2 Inclusions and Exclusions
Each package clearly defines what is included and excluded. Clients are strongly advised to review these details prior to booking.
Inclusions may typically cover:
Required government permits, national park fees, and entry tickets
Licensed guides, porters, and necessary support staff
Accommodation (hotels, tea houses, lodges, or resorts as per itinerary)
Meals as specified in the itinerary (e.g., breakfast, lunch, dinner during treks)
Ground and air transportation (private vehicles, tourist buses, domestic flights, helicopter rides or local transfers as applicable)
Applicable government taxes and company service charges
Exclusions may typically include:
International flights unless explicitly stated
Visa fees and travel documentation costs for Nepal, Tibet, Bhutan, or India unless explicitly stated
Travel and medical insurance (mandatory and to be arranged by the Client)
Personal expenses such as beverages, snacks, laundry, Wi-Fi, charging fees, and tips
Additional costs due to delays, early returns, itinerary changes, or Force Majeure events
Optional activities not listed in the confirmed itinerary
Final inclusions and exclusions will be clearly stated in the booking confirmation and agreed itinerary.
3.3 Third-Party Providers
To deliver our services, the Company works with reputable third-party providers, including lodges, hotels, airlines, transport companies, and local operators.
While we take reasonable care in selecting trusted partners, these providers operate independently and are subject to their own terms and conditions. The Company does not own or directly control these third-party entities and shall not be held liable for their acts, omissions, delays, or service disruptions.
However, we remain committed to assisting Clients and will make reasonable efforts to coordinate and support in resolving issues that may arise during the Trip.
4. Booking and Payment Terms
The following Booking and Payment Terms govern all trekking, tour, trip, adventure, and wellness services offered by Amigo Treks and Expedition Pvt. Ltd.
By confirming a booking, the Client acknowledges and agrees to these payment requirements and conditions.
4.1 Booking Process and Confirmation
Clients may book a Trip with Amigo Treks and Expedition Pvt. Ltd. through our official website, email, phone, social media platforms, or in person at our office located in Amrit Marg, Thamel, Kathmandu, Nepal.
A booking shall be considered confirmed only after the required deposit payment has been received by the Company and a written confirmation has been issued.
The Company reserves the right to decline or cancel any booking at its discretion if payment requirements are not met or if operational limitations arise.
Clients are responsible for ensuring that all personal information provided during the booking process, including passport details, travel dates, and special requirements, is accurate and complete.
4.2 Deposit Requirements
To secure reservations, permits, accommodations, transportation, and logistical arrangements, the following non-refundable booking deposit is required:
Nepal Trips: A minimum 20% of the total trip cost is required to confirm all trekking, tour, trip, adventure, and wellness packages in Nepal.
Bhutan, Tibet, and India Trips: A minimum 50% of the total trip cost is required to confirm all trips in Bhutan, Tibet, and India.
The booking deposit is used to reserve accommodations, transportation, permits, and operational services in advance and is therefore non-refundable.
However, if a Client is unable to travel, the deposit amount shall remain reusable for:
The same trip, or
Another trip of equal or similar value offered by the Company,
provided the trip is rescheduled and used within one (1) year from the original booking date.
4.3 Balance Payment Schedule
The remaining balance of the Trip cost must be paid upon arrival in Nepal and before the commencement of the Trip unless otherwise agreed in writing by the Company.
Failure to complete the balance payment before trip departure may result in cancellation of services without refund of the deposit.
Once the Trip has commenced:
For Nepal Trips, the remaining 80% balance payment, together with the previously paid 20% deposit, shall become non-refundable and non-reusable.
For Bhutan, Tibet, and India Trips, the 50% deposit already paid and any remaining payment made to the Company shall become non-refundable and non-reusable once the Trip begins.
4.4 Accepted Payment Methods
The Company accepts payments through the following methods:
Online Payment Systems
Bank/Wire Transfer
Wise (formerly TransferWise)
Credit Cards and Debit Cards
Cash
Clients are responsible for ensuring that payments are completed successfully and within the required timeframe.
Please note:
A 3.5% service charge shall apply to all payments made via credit or debit card.
Any bank fees, wire transfer charges, intermediary bank costs, currency conversion fees, or service charges imposed by financial institutions shall be borne entirely by the Client.
The Company shall only consider payment complete upon successful receipt of the full payable amount in its designated account.
4.5 Pricing, Currency, and Taxes
All trip prices are quoted in United States Dollars (USD) unless otherwise specified. Payments may also be accepted in other major currencies subject to the Company’s exchange rate policy at the time of payment.
Published trip prices generally include applicable government taxes and standard service charges, unless explicitly excluded in the package details.
The Company reserves the right to correct pricing errors, typographical mistakes, or inaccurate quotations at any time prior to booking confirmation.
4.6 Price Adjustments and Surcharges
While the Company makes every effort to maintain the quoted Trip price, we reserve the right to make reasonable price adjustments before Trip departure due to circumstances beyond our control, including, but not limited to:
Fuel price increases or transportation surcharges
Currency exchange rate fluctuations
Government tax increases or newly imposed fees
Permit cost changes or national park entry fee revisions
Unexpected regulatory or operational expenses
In such circumstances, Clients shall be informed as soon as reasonably possible and may be required to pay the applicable additional amount before departure.
These Booking and Payment Terms are intended to maintain transparency and ensure the smooth coordination of all travel arrangements provided by Amigo Treks and Expedition Pvt. Ltd.
5. Cancellations and Refund Policy
At Amigo Treks and Expedition Pvt. Ltd., we understand that travel plans may change due to unforeseen circumstances. This Cancellation and Refund Policy is designed to maintain fairness and transparency while accounting for advance operational costs, reservations, permits, accommodations, transportation, and staffing arrangements made on behalf of our Clients.
By confirming a booking, the Client agrees to the cancellation, refund, and reuse conditions stated below.
5.1 Client-Initiated Cancellations
If a Client wishes to cancel a booked Trip, written notification (via email or official communication channel) must be submitted to the Company. The effective cancellation date shall be the date on which the Company receives the written cancellation request.
Nepal Trips
For trips operated in Nepal, cancellation charges shall apply as follows:
50% cancellation charge if cancellation is received 30 days or less before the Trip departure date
80% cancellation charge if cancellation is received 15 days or less before the Trip departure date
100% cancellation charge if cancellation is received 7 days or less before the Trip departure date
Unless otherwise stated, any amount already paid to the Company shall be non-refundable but reusable for:
The same trip, or
Another trip of equal or similar value,
provided the travel is rescheduled within one (1) year from the original booking date.
Bhutan, Tibet, and India Trips
Due to strict permit regulations, advance government approvals, and supplier commitments, Bhutan, Tibet, and India trips are non-refundable and non-reusable once confirmed.
A 100% cancellation charge shall apply to all Client-initiated cancellations for Bhutan, Tibet, and India trips, regardless of cancellation timing.
5.2 Cancellation After Trip Commencement
Once the Trip has started, 100% cancellation charges shall apply if the Client voluntarily cancels, withdraws from, or leaves the Trip for any reason.
If the Customer voluntarily leaves the Trip after commencement due to personal preference, health concerns, dissatisfaction, scheduling conflicts, or any other reason, the Company shall not refund any amount already paid by the Customer.
No refunds, credits, or compensation shall be provided for:
Unused accommodation
Missed meals
Unused transportation
Trekking days not completed
Optional activities or services not utilized
Any refund or reuse request after trip commencement shall remain solely at the discretion of the Company.
5.3 Company-Initiated Cancellations
The Company reserves the right to cancel any Trip before it is guaranteed to run.
A Trip shall be considered guaranteed to run only after the required booking deposit has been received by the Company.
The Company also reserves the right to cancel any Trip, including guaranteed departures, prior to departure in the event of unfavorable or unforeseen circumstances beyond the Company’s reasonable control, including but not limited to:
Natural disasters
Flight cancellations or transportation disruption
Political unrest, riots, or civil disturbances
Strikes or industrial actions
War or security concerns
Quarantine restrictions or pandemics
Government intervention or travel restrictions
Severe weather conditions
Health and safety risks affecting operations
In such situations:
The booking deposit shall remain non-refundable, as it is used for advance reservations and operational commitments.
However, the deposit shall remain fully reusable for:
An alternative Trip of the same value, based on Client preference, or
The same Trip or another trip of similar value within one (1) year from the original booking date.
If the Client has already paid any remaining Trip balance beyond the booking deposit, such amount shall be refunded after deducting the applicable 13% Government tax and any unavoidable administrative charges or third-party non-recoverable expenses.
5.4 Refund Timelines and Administrative Fees
Where a refund is approved by the Company, refunds shall be processed within a reasonable timeframe, generally within 15 to 30 business days, depending on banking systems, payment providers, and the nature of the refund.
Please note:
Bank transfer fees, payment gateway fees, currency conversion charges, and intermediary banking charges shall be borne by the Client.
Any non-recoverable administrative or third-party charges already incurred by the Company may be deducted from the refundable amount.
Refunds shall be issued using the same payment method originally used by the Client, unless otherwise agreed in writing.
5.5 Non-Refundable Components
The following items are generally non-refundable once booked, issued, or utilized:
Booking deposits
Government permits and entry fees
Visa processing fees
Flight tickets and airline penalties
Hotel and lodge reservations already confirmed
Transportation costs already secured
Third-party supplier charges
Travel insurance premiums
Services partially or fully used by the Client
The Company shall not be liable for losses arising from missed flights, delays, force majeure events, medical emergencies, or circumstances beyond its reasonable control.
This Cancellation and Refund Policy is intended to ensure clarity and transparency for all Clients booking trekking, tour, adventure, wellness, and travel experiences with Amigo Treks and Expedition Pvt. Ltd.
6. Changes and Amendments
At Amigo Treks and Expedition Pvt. Ltd., we strive to operate all trekking, tour, trip, adventure, and wellness packages according to the confirmed itinerary. However, due to the dynamic nature of travel in Nepal, Tibet, Bhutan, and India, certain changes or amendments may become necessary to ensure safety, operational efficiency, and service quality.
By booking a Trip with the Company, the Client acknowledges and agrees to the following terms regarding itinerary modifications and service substitutions.
6.1 Client-Requested Itinerary Changes
If a Client wishes to modify a confirmed itinerary, including but not limited to travel dates, destinations, accommodation category, transportation mode, activities, duration, or other travel arrangements, such requests must be submitted to the Company in writing.
The Company will make reasonable efforts to accommodate requested changes; however, all amendments are subject to:
Availability of accommodation, transportation, permits, guides, and related services
Government regulations and destination restrictions
Feasibility of operational arrangements
Additional charges or supplier fees, if applicable
Any additional costs resulting from itinerary changes, including but not limited to permit amendments, accommodation upgrades, transportation rebooking, guide arrangements, airline fees, or administrative expenses, shall be borne entirely by the Client.
The Company shall not be held responsible if requested amendments cannot be accommodated due to availability limitations or circumstances beyond its control.
Once a Trip has commenced, itinerary modification requests may be limited or unavailable depending on local logistics, weather, permits, safety conditions, and operational feasibility.
6.2 Company’s Right to Alter Itineraries
The Company reserves the right to modify, amend, postpone, reroute, or shorten any itinerary, either before or during the Trip, when reasonably necessary to protect the safety, well-being, and overall travel experience of Clients and staff.
Such changes may be required due to circumstances including but not limited to:
Adverse weather conditions
Flight delays or cancellations
Road blockages or transportation disruptions
Natural disasters or environmental hazards
Political unrest, strikes, or government restrictions
Health concerns, altitude sickness, or medical emergencies
Safety risks or operational limitations
Changes in local regulations, permits, or access restrictions
Where possible, the Company will make reasonable efforts to inform Clients in advance and provide suitable alternatives. Any itinerary modification shall be made in good faith and with the objective of maintaining the quality and safety of the Trip.
The Company shall not be liable for any loss, delay, inconvenience, or additional expense arising from itinerary changes made due to circumstances beyond its reasonable control.
6.3 Substitution of Guides, Accommodations, and Services
The Company reserves the right to substitute guides, trekking staff, accommodations, transportation, or related travel services when necessary due to operational, safety, health, availability, or unforeseen circumstances.
This may include:
Replacement of a guide due to illness, emergency, scheduling conflict, or operational need
Alternative accommodations where originally booked lodges, hotels, or tea houses become unavailable
Changes in transportation due to weather disruptions, mechanical issues, or scheduling adjustments
Any substituted service shall be of comparable standard and quality whenever reasonably possible.
The Company will make every reasonable effort to minimize inconvenience and maintain the overall experience outlined in the original itinerary. However, such substitutions shall not constitute grounds for compensation, cancellation, or refund unless otherwise determined by the Company.
These Changes and Amendments Terms are intended to provide flexibility while ensuring safe and responsible travel operations with Amigo Treks and Expedition Pvt. Ltd.
7. Travel Insurance Requirement
At Amigo Treks and Expedition Pvt. Ltd., the safety and well-being of our Clients remain our highest priority. Due to the nature of trekking, tours, adventure travel, and high-altitude activities in Nepal, Tibet, Bhutan, and India, all Clients are strongly advised and, where applicable, required to obtain comprehensive travel insurance before participating in any Trip.
By confirming a booking, the Client acknowledges and agrees to comply with the insurance requirements stated below.
7.1 Mandatory Insurance Coverage
If you are joining any holiday, trek, tour, trip, adventure, or wellness program operated by Amigo Treks and Expedition Pvt. Ltd., you must ensure that you are adequately insured against medical and personal accident risks.
Your insurance policy must include, at a minimum:
Emergency medical treatment and hospitalization
Personal accident coverage
Emergency evacuation services
Air ambulance services (where applicable)
Helicopter rescue and evacuation coverage, particularly for trekking and remote region travel
Repatriation expenses in case of serious illness, injury, or emergency return
Given the unpredictable nature of mountain travel and adventure activities, Clients are also strongly encouraged to purchase trip cancellation insurance to protect against financial losses resulting from unexpected cancellations, delays, or travel interruptions.
Clients should carefully review their insurance policy, as some providers may exclude or restrict coverage for trekking, high-altitude travel, adventure activities, or remote-area rescue services and some policies may operate on an advance payment basis.
It is solely the Client’s responsibility to ensure that the selected policy:
Provides an adequate level of financial protection, and
Covers the specific activities, elevations, and destinations involved in the booked Trip.
7.2 Minimum Coverage Requirements
To participate in a Trip organized by the Company, the Client’s insurance policy should include sufficient financial coverage limits appropriate to the destination and activity level.
At minimum, insurance should reasonably cover:
High-altitude trekking and adventure activities (where applicable)
Emergency medical expenses
Helicopter rescue operations in mountain regions
Medical evacuation and transportation
Personal accident and injury treatment
Trip interruption or cancellation protection
For high-altitude trekking regions such as Everest, Annapurna, Langtang, and other remote destinations, Clients are strongly advised to verify that helicopter rescue and evacuation services are specifically included without altitude restrictions.
7.3 Proof of Insurance
Clients are required to carry proof of valid travel insurance, including an insurance certificate or policy documentation, throughout the duration of the Trip.
The Company reserves the right to request proof of insurance before or at the beginning of the holiday, trek, or tour.
If a Client is unable to provide proof of suitable insurance at the start of the Trip, the Client may be required to purchase an appropriate insurance policy immediately, where practically possible.
If suitable insurance:
Cannot be obtained, or
The Client refuses or fails to secure adequate coverage,
the Company reserves the right to deny participation or discontinue the Client’s Trip for safety reasons.
In such circumstances:
The Client shall not be entitled to any refund, compensation, or reimbursement for services not provided or unused portions of the Trip.
7.4 Disclaimer for Uninsured or Underinsured Clients
Amigo Treks and Expedition Pvt. Ltd. shall not be held responsible or liable for any medical expenses, evacuation costs, rescue operations, trip interruption losses, personal injury claims, or financial damages incurred by a Client who travels without adequate insurance coverage.
Any costs arising from:
Medical treatment
Helicopter rescue or air evacuation
Hospitalization
Emergency transportation
Trip interruption or cancellation
Personal injury or property loss
shall remain the sole responsibility of the Client.
The Company accepts no liability for claims rejected by an insurance provider, including situations where the Client fails to obtain proper coverage for trekking, adventure travel, altitude-related emergencies, or other activities included in the Trip.
These Travel Insurance Requirements are established to protect both Clients and the Company and to ensure safer travel experiences with Amigo Treks and Expedition Pvt. Ltd. across Nepal, Tibet, Bhutan, and India.
8. Health, Fitness, and Medical Disclosure
At Amigo Treks and Expedition Pvt. Ltd., the safety, well-being, and successful travel experience of every Client are of utmost importance. Many trekking, tour, adventure, and wellness activities operated by the Company involve physical exertion, high-altitude environments, remote travel, changing weather conditions, and limited medical facilities.
Therefore, Clients are required to carefully assess their health and fitness before booking a Trip.
By confirming a booking, the Client acknowledges and agrees to the health, fitness, and medical requirements outlined below.
8.1 Client Responsibility to Disclose Medical Conditions
Clients are responsible for ensuring that they are physically and medically fit to participate in the booked Trip and must disclose any pre-existing medical condition, physical limitation, injury, disability, allergy, dietary restriction, or other health-related concern that may affect their ability to travel safely.
Medical disclosures should be communicated to the Company at the time of booking or as soon as reasonably possible before departure, particularly if the Client has conditions that may require special arrangements or emergency support.
This includes, but is not limited to:
Heart or respiratory conditions
High blood pressure or circulation issues
Diabetes or chronic illness
Severe allergies or food sensitivities
Mobility limitations or physical injuries
History of altitude-related illness
Recent surgeries or medical treatment
Any condition requiring regular medication or medical supervision
Failure to disclose relevant medical information may affect the Company’s ability to provide appropriate assistance and may result in the Company declining participation or discontinuing services if safety concerns arise.
Clients are solely responsible for:
Carrying sufficient personal medication during the Trip
Consulting a medical professional before travel, where necessary
Ensuring their physical condition is suitable for the booked activity and destination
8.2 Required Fitness Level
Certain treks, tours, adventure activities, and wellness programs may require a minimum level of physical fitness and endurance, depending on the destination, altitude, duration, terrain, and travel conditions.
Clients are advised to carefully review the Trip difficulty level, trekking hours, elevation gain, and physical demands described in the itinerary before confirming a booking.
For trekking and high-altitude programs, Clients should reasonably expect:
Long walking or hiking days on uneven terrain
Exposure to high altitudes and changing weather conditions
Limited access to medical facilities in remote areas
Physical demands associated with mountain travel and outdoor activities
While prior trekking experience may not always be required, Clients should possess a fitness level appropriate to the chosen itinerary and are encouraged to prepare physically in advance.
The Company reserves the right to advise Clients if a selected Trip may not be suitable based on disclosed health or fitness information.
8.3 Company’s Right to Refuse Participation or Remove a Client for Safety Reasons
The Company reserves the right to refuse participation, deny continuation, or remove a Client from a Trip, either before or during travel, where the Company reasonably determines that the Client:
Is medically unfit to participate safely
Poses a risk to their own safety or well-being
Poses a risk to guides, staff, other travelers, or local communities
Fails to follow safety instructions or operational guidance
Displays behavior that disrupts the Trip or compromises group safety
Experiences serious illness, injury, or altitude-related health concerns during the Trip
Any decision to refuse or discontinue participation shall be made in good faith and in the interest of safety.
In such circumstances:
The Company may arrange reasonable assistance where practically possible; however,
No refund, compensation, or reimbursement shall be provided for unused services, missed activities, accommodation, transportation, or other Trip components.
Any additional costs arising from medical treatment, evacuation, accommodation changes, transportation, or early return arrangements shall remain the sole responsibility of the Client.
These Health, Fitness, and Medical Disclosure Terms are intended to promote safe, responsible, and enjoyable travel experiences with Amigo Treks and Expedition Pvt. Ltd. across Nepal, Tibet, Bhutan, and India.
9. Assumption of Risk
At Amigo Treks and Expedition Pvt. Ltd., we are committed to organizing safe, professionally managed, and rewarding trekking, tour, adventure, wellness, and travel experiences across Nepal, Tibet, Bhutan, and India.
However, Clients should understand that travel—particularly trekking, high-altitude journeys, adventure activities, and remote-area travel—may involve inherent risks that cannot be entirely eliminated, even with proper planning, safety procedures, and experienced guidance.
By confirming a booking and participating in a Trip, the Client acknowledges and accepts the risks outlined below.
9.1 Acknowledgment of Inherent Risks
The Client understands and accepts that participation in trekking, tours, trips, adventure activities, wellness programs, transportation, and related travel services may involve foreseeable and unforeseeable risks, including but not limited to:
Health and Altitude Risks
High-altitude conditions and reduced oxygen levels
Altitude sickness or altitude-related medical complications
Fatigue, dehydration, physical exhaustion, or illness
Limited or delayed access to medical facilities in remote regions
Weather and Environmental Risks
Sudden weather changes
Heavy rainfall, snow, storms, landslides, flooding, avalanches, or natural hazards
Extreme temperatures and environmental exposure
Terrain and Physical Risks
Uneven trails, steep paths, rocky surfaces, river crossings, and mountainous terrain
Slips, falls, injuries, or accidents during trekking, hiking, or outdoor activities
Transportation delays or disruptions due to road or trail conditions
Political and Operational Risks
Political unrest, demonstrations, strikes, border restrictions, or government intervention
Flight delays, cancellations, or transportation interruptions
Changes in local regulations, permit restrictions, or access limitations
Remote Travel Risks
Limited communication networks and emergency services
Delays in rescue or evacuation operations due to weather, geography, or infrastructure limitations
The Client acknowledges that such risks may result in itinerary changes, delays, discomfort, illness, property loss, injury, additional expenses, or Trip interruption.
Although the Company takes reasonable precautions, provides experienced staff, and follows safety practices, Amigo Treks and Expedition Pvt. Ltd. cannot guarantee a risk-free travel experience.
9.2 Voluntary Participation Clause
By booking and participating in a Trip, the Client confirms that participation is entirely voluntary and undertaken at their own discretion and risk.
The Client acknowledges that they:
Have carefully reviewed the nature of the booked Trip and its physical requirements
Understand the potential hazards associated with trekking, touring, adventure activities, wellness travel, and remote destinations
Accept personal responsibility for their participation and decision to travel
Have obtained adequate travel and medical insurance as required by the Company
Are physically and mentally capable of participating in the selected itinerary
The Client further agrees to follow:
Instructions provided by guides and Company staff
Local laws, regulations, and safety procedures
Operational decisions made in the interest of safety and group welfare
The Company reserves the right to modify, suspend, or terminate participation if necessary to protect the safety and well-being of the Client, staff, or other travelers.
By proceeding with a booking, the Client expressly acknowledges the inherent risks associated with travel and adventure activities and voluntarily accepts such risks as part of participating in services provided by Amigo Treks and Expedition Pvt. Ltd.
10. Limitation of Liability
At Amigo Treks and Expedition Pvt. Ltd., we are committed to delivering safe, professional, and reliable trekking, tour, trip, adventure, and wellness services across Nepal, Tibet, Bhutan, and India.
However, due to the nature of travel and reliance on third-party providers, certain risks and circumstances remain beyond the Company’s reasonable control.
This Limitation of Liability clause defines the extent of the Company’s legal responsibility and applies to all services, bookings, and travel arrangements provided by Amigo Treks and Expedition Pvt. Ltd.
10.1 Limitation of Liability to the Extent Permitted by Law
To the maximum extent permitted under applicable law, the total liability of Amigo Treks and Expedition Pvt. Ltd., including its directors, employees, guides, representatives, contractors, affiliates, and agents, arising out of or relating to any booking, Trip, service, or these Terms and Conditions, shall be limited to the total amount actually paid by the Client to the Company for the specific Trip giving rise to the claim.
The Company shall not be held liable for any loss, injury, delay, inconvenience, expense, or disruption arising directly or indirectly from circumstances beyond its reasonable control, including but not limited to:
Natural disasters or extreme weather conditions
Flight delays, cancellations, or transportation disruptions
Political unrest, government restrictions, strikes, or border closures
Illness, altitude-related conditions, or medical emergencies
Acts or omissions of third-party service providers
Force Majeure events as defined in these Terms and Conditions
The Client acknowledges that travel in mountain, remote, or developing regions may involve operational limitations and accepts that certain risks cannot be fully prevented.
10.2 Exclusion of Indirect, Consequential, or Incidental Damages
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, losses, or expenses arising from or related to a Trip or service, including but not limited to:
Loss of enjoyment or missed travel opportunities
Missed international or domestic flight connections
Hotel expenses arising from delays or cancellations
Emotional distress or inconvenience
Loss, theft, or damage to personal belongings or baggage
Additional costs resulting from itinerary changes or delays
The Company shall also not be liable for any financial loss caused by:
Exchange rate fluctuations
Changes in government fees, taxes, or permit costs
Airline schedule changes or supplier-related disruptions
Clients are strongly encouraged to obtain comprehensive travel insurance to protect against such risks and unexpected expenses.
10.3 Third-Party Provider Liability
The Company may arrange services provided by third-party suppliers, including airlines, hotels, lodges, transportation companies, local operators, and activity providers.
While the Company takes reasonable care in selecting reputable service providers, such entities operate independently and remain responsible for their own services.
Accordingly, the Company shall not be held liable for acts, omissions, delays, negligence, accidents, or service failures caused by third-party providers.
Any claims relating to third-party services shall be subject to the terms and liability policies of the relevant provider.
10.4 Liability Carve-Outs
Nothing in these Terms and Conditions shall exclude or limit the Company’s liability where such limitation is prohibited by applicable law.
In particular, this Limitation of Liability shall not apply in cases involving:
Gross negligence by the Company
Willful misconduct or intentional wrongdoing by the Company
Fraudulent misrepresentation
Liability that cannot legally be excluded or limited under the laws of Nepal or other applicable jurisdictions
Where liability cannot be excluded by law, such liability shall be limited only to the minimum extent permitted under applicable legislation.
By booking or participating in any Trip organized by Amigo Treks and Expedition Pvt. Ltd., the Client acknowledges and agrees to the limitations of liability set forth in this section and accepts that adventure travel, trekking, and remote-area journeys inherently involve risks and operational uncertainties.
11. Indemnification
At Amigo Treks and Expedition Pvt. Ltd., we are committed to maintaining safe, respectful, and professionally managed trekking, tour, trip, adventure, and wellness experiences.
To protect the interests of the Company, its staff, guides, service providers, and other travelers, Clients are required to accept responsibility for their own conduct and compliance with these Terms and Conditions.
By booking or participating in any Trip organized by Amigo Treks and Expedition Pvt. Ltd., the Client agrees to the indemnification obligations outlined below.
11.1 Client Indemnification Obligation
The Client agrees to indemnify, defend, and hold harmless Amigo Treks and Expedition Pvt. Ltd., including its directors, employees, guides, representatives, contractors, affiliates, agents, and third-party service providers, from and against any and all:
Claims
Liabilities
Damages
Losses
Penalties
Fines
Legal expenses and reasonable attorney or professional fees
Costs and expenses of any nature
arising directly or indirectly from:
The Client’s breach of these Terms and Conditions
Violation of local laws, regulations, permits, or travel requirements
The Client’s negligent, reckless, unlawful, or inappropriate conduct during the Trip
Damage caused by the Client to accommodation, vehicles, equipment, property, or third-party facilities
Injury, loss, or harm caused to other travelers, guides, staff, local communities, or third parties due to the Client’s actions or omissions
Failure to follow safety instructions, operational guidance, or reasonable directions issued by Company staff or guides
Misrepresentation, omission, or failure to disclose relevant health, travel, or personal information during booking or travel
The Client shall remain personally responsible for any financial or legal consequences resulting from their conduct.
11.2 Responsibility for Personal Conduct
Clients are expected to behave in a lawful, respectful, and responsible manner throughout the Trip.
The Company reserves the right to remove or deny participation to any Client whose conduct:
Endangers the safety or well-being of themselves or others
Disrupts the travel experience of the group
Violates local laws, cultural practices, or regulations
Causes damage to property, accommodation, vehicles, or equipment
In such cases:
The Client shall bear any resulting costs, penalties, compensation claims, or legal liabilities, and
No refund or reimbursement shall be provided for unused services.
11.3 No Limitation on Legal Remedies
Nothing in this section shall limit the Company’s right to pursue additional legal remedies or compensation where permitted under applicable law for damages, losses, or liabilities caused by the Client.
The Company reserves the right to seek reimbursement from the Client for any expenses reasonably incurred in responding to claims or resolving disputes arising from the Client’s actions, negligence, or breach of these Terms and Conditions.
By confirming a booking or participating in a Trip, the Client acknowledges and agrees to indemnify Amigo Treks and Expedition Pvt. Ltd. against claims, liabilities, and losses resulting from the Client’s own conduct, negligence, breach, or failure to comply with applicable laws and Company policies.
12. Force Majeure
At Amigo Treks and Expedition Pvt. Ltd., we make every reasonable effort to operate all trekking, tour, trip, adventure, and wellness programs as planned.
However, certain circumstances may arise that are beyond the reasonable control of the Company and may prevent, delay, disrupt, or materially affect the operation of a Trip.
This section outlines the Company’s rights and responsibilities in situations involving Force Majeure events.
12.1 Definition of Force Majeure
For the purpose of these Terms and Conditions, “Force Majeure” refers to any event, circumstance, or condition that is unforeseeable, unavoidable, or beyond the reasonable control of the Company, which prevents or significantly interferes with the performance of contractual obligations.
Force Majeure events include, but are not limited to:
Natural disasters, including earthquakes, floods, landslides, avalanches, storms, wildfires, or severe weather conditions
Pandemics, epidemics, outbreaks of infectious disease, quarantine restrictions, or public health emergencies
Government actions, including travel bans, visa restrictions, border closures, permit suspensions, regulatory changes, or mandatory evacuation orders
Political unrest, civil disturbances, riots, terrorism threats, armed conflict, war, or military action
Strikes, lockouts, labor disputes, or industrial actions affecting transportation or travel services
Transportation disruptions, including canceled or delayed flights, road blockages, airport closures, fuel shortages, or mechanical failures
Power outages, communication failures, or disruptions to essential infrastructure
Any other event or circumstance beyond the Company’s reasonable control that materially impacts travel operations
The Company shall determine, acting reasonably and in good faith, whether an event qualifies as a Force Majeure circumstance.
12.2 Suspension or Termination of Obligations
In the event of a Force Majeure situation, the Company reserves the right to suspend, modify, postpone, reroute, shorten, or terminate any Trip, service, or contractual obligation, either temporarily or permanently, where necessary to protect the safety of Clients, staff, or operational integrity.
This may include:
Delaying departure dates
Modifying itineraries or destinations
Substituting transportation, accommodation, or services
Suspending or canceling a Trip before or after departure
Where reasonably possible, the Company will make good-faith efforts to:
Inform Clients promptly of changes, and
Offer alternative travel arrangements, rescheduling options, or reusable travel credits in accordance with applicable Company policies.
However, the Company shall not be obligated to continue operations where doing so would be unsafe, impractical, unlawful, or impossible.
Any refunds, credits, or trip reuse options in Force Majeure situations shall be subject to the Company’s applicable Cancellation and Refund Policy and any unavoidable third-party costs already incurred.
12.3 No Liability for Delays or Cancellations Due to Force Majeure
To the fullest extent permitted by law, Amigo Treks and Expedition Pvt. Ltd. shall not be liable for any delay, cancellation, interruption, loss, injury, inconvenience, additional expense, or failure to perform services resulting directly or indirectly from a Force Majeure event.
The Company shall not be responsible for losses including, but not limited to:
Missed international or domestic flights
Additional accommodation or transportation costs
Lost travel time or itinerary disruptions
Financial losses, missed business opportunities, or emotional distress
Expenses caused by government restrictions or emergency measures
Clients acknowledge that travel to mountain regions and international destinations may involve circumstances outside the Company’s control and agree that the Company shall not be held responsible for disruptions caused by Force Majeure events.
Clients are strongly advised to obtain comprehensive travel insurance, including coverage for trip cancellation, interruption, medical emergencies, and evacuation, to protect against unexpected losses arising from such events.
By confirming a booking or participating in a Trip, the Client acknowledges the possibility of Force Majeure events and agrees that Amigo Treks and Expedition Pvt. Ltd. shall not be held liable for disruptions, delays, or cancellations arising from circumstances beyond its reasonable control.
13. Guide and Staff Authority
At Amigo Treks and Expedition Pvt. Ltd., the safety, coordination, and success of every trekking, tour, trip, adventure, and wellness experience depend on professional leadership and responsible participation.
Our guides and staff are trained to make operational and safety-related decisions in the best interests of Clients, team members, and overall Trip management.
By joining any Trip organized by the Company, the Client agrees to respect the authority of Company guides and staff and comply with all reasonable instructions issued during the Trip.
13.1 Authority of Guides and Staff During Trips
All treks, tours, adventure activities, and related travel services operated by Amigo Treks and Expedition Pvt. Ltd. are managed or supervised by experienced guides, tour leaders, and operational staff.
For the safety and smooth operation of the Trip, Company guides and staff shall have the authority to make reasonable decisions relating to itinerary management, logistics, safety, health, weather conditions, transportation, accommodation, and group welfare.
Such authority may include decisions regarding:
Route changes or itinerary adjustments
Walking pace and daily schedules
Weather-related safety measures
Emergency response procedures
Accommodation or transportation substitutions
Health-related decisions, including altitude management and rest requirements
Group coordination and operational logistics
All decisions made by Company staff shall be exercised in good faith and in the interest of safety, practicality, and responsible Trip management.
13.2 Client Obligation to Follow Instructions
Clients are required to follow all reasonable instructions, guidelines, and safety directions provided by Company guides and staff throughout the Trip.
This obligation includes, but is not limited to:
Following trekking routes and designated travel plans
Respecting health and safety advice, including acclimatization recommendations
Complying with local laws, regulations, and cultural practices
Following emergency procedures and operational guidance
Acting respectfully toward guides, staff, fellow travelers, local communities, and service providers
Clients are expected to cooperate with guides and staff in a manner that promotes a safe, respectful, and enjoyable travel experience for everyone involved.
Failure to follow reasonable instructions may create safety risks, disrupt operations, or negatively affect the experience of other participants.
13.3 Removal of Non-Compliant Clients
The Company reserves the right to refuse participation, suspend involvement, or remove a Client from a Trip, without prior notice, if the Client:
Fails or refuses to comply with reasonable instructions from guides or staff
Engages in behavior that compromises personal or group safety
Disrupts the Trip or negatively affects other travelers
Violates local laws, regulations, or cultural norms
Acts in an abusive, threatening, reckless, unlawful, or irresponsible manner
Is medically unfit to continue, based on reasonable assessment by guides or staff
Any decision to remove or discontinue a Client’s participation shall be made reasonably and in good faith, with consideration for safety and operational needs.
In such cases:
No refund, compensation, or reimbursement shall be provided for unused services, accommodation, transportation, or missed activities.
Any additional costs arising from early departure, transportation, accommodation, medical care, or alternative arrangements shall be the sole responsibility of the Client.
By participating in any Trip organized by Amigo Treks and Expedition Pvt. Ltd., the Client acknowledges the authority of Company guides and staff and agrees to follow all reasonable instructions to help maintain a safe and well-managed travel experience.
14. Environmental and Cultural Responsibility
At Amigo Treks and Expedition Pvt. Ltd., we are committed to promoting responsible, sustainable, and respectful travel across Nepal, Tibet, Bhutan, and India.
Many destinations visited during treks, tours, adventure, and wellness programs are environmentally sensitive, culturally significant, and home to local communities with unique traditions and customs.
Clients are expected to travel responsibly and contribute positively to the protection of local environments, cultures, heritage, and communities.
By participating in any Trip organized by the Company, the Client agrees to comply with the environmental and cultural responsibilities outlined below.
14.1 Compliance with Local Laws and Customs
Clients are required to respect and comply with all applicable local laws, regulations, cultural norms, and community practices throughout the Trip.
This includes, but is not limited to:
Respecting local traditions, customs, and religious practices
Dressing appropriately in culturally sensitive or religious areas
Seeking permission before photographing individuals, religious ceremonies, or restricted locations where required
Respecting local wildlife, natural habitats, and sacred sites
Following regional travel rules, permit requirements, and government regulations
Clients are expected to conduct themselves in a respectful and responsible manner toward:
Local communities and residents
Religious and cultural institutions
Fellow travelers and Company staff
Local businesses and service providers
Any unlawful, disrespectful, disruptive, or culturally insensitive behavior may result in removal from the Trip without refund.
14.2 Environmental Protection Obligations
The Company encourages environmentally responsible travel and expects all Clients to actively help reduce environmental impact during trekking, touring, and adventure activities.
Clients agree to:
Avoid littering and dispose of waste responsibly
Minimize the use of single-use plastics where possible
Respect wildlife and avoid disturbing animals or natural habitats
Protect water sources and avoid contamination of rivers, lakes, and local ecosystems
Stay on designated trails and trekking routes whenever instructed
Avoid damaging vegetation, historical landmarks, or protected areas
Follow waste management practices recommended by guides and local authorities
Clients shall be responsible for any damage caused to the environment, accommodation, property, or protected sites due to negligent or intentional conduct.
14.3 “Leave No Trace” Principles
To help preserve natural landscapes and trekking regions for future generations, Clients are expected to follow the internationally recognized “Leave No Trace” principles wherever reasonably applicable.
These principles include:
Travel and camp responsibly and respect designated routes and areas
Dispose of waste properly, including personal and non-biodegradable items
Leave natural and cultural sites undisturbed and avoid removing objects or artifacts
Respect wildlife and local ecosystems by observing from a distance and avoiding interference
Minimize environmental impact through responsible consumption and resource use
Be considerate of local communities and fellow travelers
The Company and its guides may provide additional environmental guidance during the Trip based on local regulations, conservation practices, and destination-specific requirements.
14.4 Company Commitment to Responsible Tourism
Amigo Treks and Expedition Pvt. Ltd. actively supports responsible tourism, cultural preservation, and environmental sustainability and encourages all Clients to travel in a way that benefits local communities while protecting natural and cultural heritage.
The Company reserves the right to take reasonable action, including restricting participation or removing a Client from a Trip, where conduct causes significant environmental harm or serious cultural disrespect.
By participating in any Trip organized by Amigo Treks and Expedition Pvt. Ltd., the Client agrees to travel responsibly, respect local customs, and support environmental conservation through sustainable and ethical travel practices.
15. Permits and Documentation
At Amigo Treks and Expedition Pvt. Ltd., we assist all Clients in coordinating travel arrangements for trekking, tours, trips, adventure, and wellness programs across Nepal, Tibet, Bhutan, and India.
However, it remains the sole responsibility of the Client to ensure that all required travel documents, permits, and identification are valid, accurate, and available before and during travel.
By confirming a booking, the Client acknowledges and agrees to the documentation responsibilities outlined below.
15.1 Responsibility for Passports, Visas, and Permits
Clients are solely responsible for obtaining and maintaining all necessary travel documentation, including but not limited to:
Valid passport
Entry visas and travel authorizations (Nepal and India)
Trekking permits and restricted area permits (where applicable)
Travel insurance documentation
Vaccination or health-related certificates, if required
Any additional government approvals or supporting documents
The Company may provide general information or reasonable required assistance regarding permit procedures and visa requirements; however, such assistance is provided for informational purposes only and does not constitute legal, immigration, or governmental advice.
Clients are responsible for verifying all entry requirements directly with:
Relevant embassies or consulates
Immigration authorities
Government agencies of the destination country
15.2 Passport Validity Requirement
All Clients must travel with a passport that remains valid for at least six (6) months beyond the scheduled end date of the Trip.
It is the Client’s responsibility to ensure that:
Their passport is valid and in good condition
There are sufficient blank visa pages, where required
Names and travel details match booking and ticket information
Failure to meet passport validity requirements may result in denied boarding, visa rejection, entry refusal, or travel disruption, for which the Company shall bear no responsibility.
15.3 Trekking Permits and Regional Documentation
For trekking, restricted area access, and certain destinations, government-issued permits and travel authorizations may be mandatory.
Where permit arrangements are included in the booked package, the Client must provide accurate documentation in a timely manner, including but not limited to:
Passport copies
Passport-size photographs
Visa details
Travel forms or declarations as required
Delays in providing required information may affect the Company’s ability to secure permits or operate the Trip as planned.
The Company shall not be liable for permit denial, delays, or restrictions imposed by government authorities.
15.4 Consequences of Improper or Incomplete Documentation
Clients who fail to carry valid or sufficient travel documentation may face:
Refusal of visa approval or permit issuance
Denied airline boarding or border entry
Travel delays or cancellation
Removal from certain activities or restricted areas
Additional transportation, accommodation, or administrative expenses
If a Client is unable to participate in all or part of a Trip due to invalid, expired, incorrect, lost, or incomplete documentation, the Company shall not be responsible for any resulting loss, delay, missed services, or financial damages.
In such cases:
No refund, compensation, or reimbursement shall be provided for unused services, permits, accommodation, transportation, or missed activities.
Any additional costs incurred shall remain the sole responsibility of the Client.
Amigo Treks and Expedition Pvt. Ltd. strongly recommends that all Clients carefully review passport validity, visa requirements, permits, and travel documentation well in advance of departure to ensure a smooth and hassle-free travel experience.
16. Use of Images and Marketing Consent
At Amigo Treks and Expedition Pvt. Ltd., we occasionally capture photographs, videos, testimonials, and other media during trekking, tours, trips, adventure, and wellness activities to document travel experiences and promote our services. These materials may be used to showcase authentic travel experiences across Nepal, Tibet, Bhutan, and India.
By participating in a Trip organized by the Company, the Client acknowledges and agrees to the image and marketing consent terms outlined below.
16.1 Consent to Use Photographs and Videos
During the course of a Trip, the Company, its staff, guides, photographers, videographers, or authorized representatives may take photographs, videos, audio recordings, or other visual content featuring Clients, group activities, landscapes, accommodations, and travel experiences.
Unless otherwise requested in writing by the Client, the Client grants Amigo Treks and Expedition Pvt. Ltd. a non-exclusive, worldwide, royalty-free, and perpetual right to use, reproduce, publish, edit, distribute, display, or share such materials for legitimate business and promotional purposes.
This may include use on:
The Company’s official website
Social media platforms (including Facebook, Instagram, LinkedIn, YouTube, and similar channels)
Blogs, newsletters, brochures, advertisements, and promotional campaigns
Printed and digital marketing materials
Travel-related publications and presentations
The Company may use such content to promote trekking, tours, trips, adventure, and wellness experiences, provided such use is reasonable and professional in nature.
Clients shall not be entitled to compensation, royalties, or payment for the use of such materials.
16.2 Respect for Privacy and Appropriate Use
The Company will make reasonable efforts to ensure that photographs and videos are used in a respectful and appropriate manner and shall avoid intentionally using content that may be misleading, defamatory, or unnecessarily intrusive.
The Company will not knowingly use images in a manner intended to harm the reputation, dignity, or privacy of any Client.
16.3 Opt-Out Provision
Clients who do not wish to appear in photographs, videos, or marketing materials may opt out by notifying the Company in writing prior to the start of the Trip, or by informing Company staff or guides at the earliest reasonable opportunity during the Trip.
While the Company will make reasonable efforts to honor such requests, Clients acknowledge that:
Group photographs or public travel settings may make complete exclusion impractical in certain situations.
Incidental appearance in group media may not always be avoidable.
Where a valid opt-out request is received, the Company will take reasonable steps to avoid using clearly identifiable images or footage of the Client in future promotional materials.
16.4 Client-Provided Content
If a Client voluntarily shares photographs, testimonials, reviews, videos, or social media content with the Company for promotional purposes, the Client grants the Company permission to use such materials in accordance with this section unless otherwise expressly restricted in writing.
By participating in a Trip with Amigo Treks and Expedition Pvt. Ltd., the Client acknowledges and agrees to the Company’s reasonable use of travel-related photographs and videos for marketing, promotional, and business purposes, subject to any valid opt-out request submitted by the Client.
17. Complaints and Dispute Resolution
At Amigo Treks and Expedition Pvt. Ltd., we are committed to providing high-quality trekking, tour, trip, adventure, and wellness experiences across Nepal, Tibet, Bhutan, and India. We value Client feedback and aim to resolve concerns fairly, efficiently, and professionally.
If a Client experiences dissatisfaction or wishes to raise a complaint regarding any aspect of a Trip or service, the following complaint and dispute resolution procedure shall apply.
17.1 On-Trip Complaint Procedure
If a Client experiences any issue, concern, dissatisfaction, or service-related problem during the Trip, the Client is encouraged to immediately inform the assigned guide, tour leader, or Company representative so that reasonable efforts can be made to resolve the matter promptly.
Clients should raise concerns as soon as reasonably possible during the Trip to allow the Company an opportunity to:
Investigate the matter
Provide clarification or corrective action
Arrange alternative solutions where reasonably practical
Minimize disruption to the travel experience
The Company shall not be responsible for complaints that could have been reasonably addressed during the Trip but were not reported in a timely manner.
Where possible, Clients are encouraged to document concerns with relevant details, including dates, locations, photographs, receipts, or supporting information.
17.2 Post-Trip Claims Timeline
If a concern remains unresolved after completion of the Trip, the Client may submit a formal written complaint to the Company.
All post-trip claims or complaints must be submitted within seven (7) calendar days from the Trip completion date.
The complaint should include:
Full name and booking reference details
Description of the issue or claim
Relevant supporting documents or evidence
Any steps already taken to resolve the issue during the Trip
Complaints submitted after the stated timeframe may be difficult to investigate and may be declined at the Company’s discretion.
The Company will make reasonable efforts to acknowledge and review complaints in a timely manner and may request additional information if necessary.
17.3 Escalation and Resolution Mechanism
The Company aims to resolve disputes through good-faith communication and amicable settlement whenever possible.
Complaint resolution shall generally follow the process below:
Step 1: On-Trip Resolution
The Client should first raise concerns with the guide, trip leader, or local Company representative during the Trip.
Step 2: Formal Written Complaint
If unresolved, the Client may submit a written complaint to the Company within the required timeframe.
Step 3: Internal Review and Escalation
The matter may be escalated to Company management for formal review and resolution.
The Company will assess complaints reasonably and may offer clarification, corrective action, goodwill measures, or settlement where appropriate and justified.
17.4 Dispute Resolution and Governing Jurisdiction
If a dispute cannot be resolved through internal communication and good-faith efforts, the parties agree to first attempt resolution through negotiation or mutual discussion.
Where resolution cannot be achieved, any legal dispute, claim, or controversy arising from or relating to the Company’s services, bookings, or these Terms and Conditions shall be governed by the laws of Nepal and subject to the exclusive jurisdiction of the competent courts of Kathmandu, Nepal.
To the fullest extent permitted by law, both parties agree to seek an amicable resolution before commencing formal legal proceedings.
By booking or participating in any Trip organized by Amigo Treks and Expedition Pvt. Ltd., the Client agrees to follow the complaint and dispute resolution procedures outlined above to ensure fair and timely handling of concerns.
18. Governing Law and Jurisdiction
This Governing Law and Jurisdiction clause establishes the legal framework applicable to all bookings, services, and disputes relating to trekking, tours, trips, adventure, and wellness programs organized by Amigo Treks and Expedition Pvt. Ltd.
By booking or participating in any Trip organized by the Company, the Client agrees to the legal provisions outlined below.
18.1 Applicable Law
These Terms and Conditions, together with any booking agreement, service arrangement, or dispute arising out of or relating to services provided by Amigo Treks and Expedition Pvt. Ltd., shall be governed by and interpreted in accordance with the laws of Nepal, without regard to any conflict of law principles.
This applies to all matters related to:
Trip bookings and travel services
Payment obligations and cancellations
Liability and indemnification
Health, safety, and operational matters
Dispute resolution and legal claims
Any contractual or non-contractual obligations arising from the Client’s relationship with the Company
The Client acknowledges that the Company is a government-licensed travel and trekking company registered and operating in Nepal, with its principal office located in Amrit Marg, Thamel, Kathmandu, Nepal.
18.2 Good-Faith Resolution and Negotiation
Before initiating formal legal proceedings, both the Company and the Client agree to make reasonable efforts to resolve any dispute through good-faith communication, negotiation, or mutual discussion.
Clients are encouraged to first follow the Company’s internal Complaints and Dispute Resolution Procedure and provide the Company with a reasonable opportunity to investigate and address any concern.
18.3 Exclusive Jurisdiction
If a dispute, claim, controversy, or legal proceeding cannot be resolved amicably, the parties agree that such matter shall be subject to the exclusive jurisdiction of the competent courts of Kathmandu, Nepal.
The Client expressly agrees that:
Any legal claim or proceeding arising from or relating to a Trip, booking, service, or these Terms and Conditions shall be filed only in Kathmandu, Nepal.
The courts of Kathmandu shall have exclusive authority to hear and determine such disputes.
The Client waives any objection relating to venue, inconvenience, or jurisdiction in any other country or court, to the extent permitted by applicable law.
18.4 Arbitration (Optional Pre-Litigation Resolution)
At the Company’s discretion or by mutual agreement between the parties, disputes may first be submitted for mediation or arbitration in Kathmandu, Nepal, prior to formal court proceedings.
Unless otherwise agreed in writing:
Any arbitration proceedings shall be conducted in English, and
The decision of the arbitrator(s), where legally binding, may be enforceable under applicable Nepalese law.
Nothing in this clause shall prevent either party from seeking urgent legal relief or remedies available under applicable law where immediate action is reasonably necessary.
By confirming a booking or participating in any Trip organized by Amigo Treks and Expedition Pvt. Ltd., the Client acknowledges and agrees that these Terms and Conditions shall be governed by the laws of Nepal and that any unresolved legal dispute shall fall under the exclusive jurisdiction of the courts of Kathmandu, Nepal.
19. Severability
At Amigo Treks and Expedition Pvt. Ltd., these Terms and Conditions are intended to operate as a legally valid and enforceable agreement between the Company and the Client. However, if any provision is found to be unenforceable or invalid under applicable law, the remaining provisions shall continue to remain in full force and effect.
19.1 Validity of Remaining Provisions
If any provision, clause, term, or part of these Terms and Conditions is determined by a court of competent jurisdiction, governmental authority, or applicable law to be:
Invalid
Illegal
Unenforceable
Void in whole or in part
such determination shall not affect the validity, legality, or enforceability of the remaining provisions of these Terms and Conditions.
All remaining clauses shall continue to be interpreted and enforced to the maximum extent permitted by law as though the invalid or unenforceable provision had never formed part of the agreement.
19.2 Modification of Invalid Provisions
Where reasonably possible, any invalid, illegal, or unenforceable provision shall be interpreted or modified in a manner that most closely reflects the original legal intent and commercial purpose of the affected clause while remaining compliant with applicable law.
If modification is not legally possible, the affected provision shall be deemed severed from these Terms and Conditions without affecting the continued operation of the remaining sections.
19.3 Continued Effect of Agreement
The Client acknowledges and agrees that the invalidity or unenforceability of any individual clause shall not release either party from their obligations under the remaining Terms and Conditions.

Bookings and payments
Cancellations and refunds
Liability limitations
Insurance requirements
Health and safety obligations
Dispute resolution and governing law
Environmental and cultural responsibilities
shall continue to remain legally binding and enforceable.
By confirming a booking or participating in any Trip organized by Amigo Treks and Expedition Pvt. Ltd., the Client agrees that if any provision of these Terms and Conditions is held invalid or unenforceable, the remainder of the agreement shall continue in full force and effect.
20. Entire Agreement
This Entire Agreement clause defines the complete understanding between Amigo Treks and Expedition Pvt. Ltd. and the Client regarding all trekking, tour, trip, adventure, and wellness services provided by the Company.
By confirming a booking or participating in any Trip organized by the Company, the Client acknowledges and agrees to the terms set forth below.
20.1 Complete Agreement Between the Parties
These Terms and Conditions, together with the confirmed itinerary, booking confirmation, payment terms, cancellation policy, privacy policy, and any written agreements expressly issued by Amigo Treks and Expedition Pvt. Ltd., constitute the entire agreement between the Company and the Client relating to the booked Trip and related services.
This agreement supersedes and replaces all prior discussions, negotiations, understandings, communications, representations, promotional materials, proposals, or agreements, whether oral or written, relating to the same booking or Trip.
No statement, representation, promise, warranty, or assurance made by any employee, guide, representative, agent, or third party shall be legally binding unless expressly confirmed in writing by the Company.
20.2 Reliance on Written Confirmations
Clients acknowledge that travel arrangements, pricing, inclusions, exclusions, itinerary details, and service commitments are governed solely by:

Written booking confirmation issued by the Company

Any written amendments expressly approved by the Company
Clients should not rely on informal discussions, verbal assurances, social media messages, promotional content, or third-party information unless such information is formally incorporated into the booking agreement in writing.
20.3 Amendments to the Agreement
No amendment, modification, waiver, or variation of these Terms and Conditions shall be valid unless made in writing and approved by an authorized representative of Amigo Treks and Expedition Pvt. Ltd.

By confirming a booking with Amigo Treks and Expedition Pvt. Ltd., the Client acknowledges that these Terms and Conditions represent the complete and exclusive agreement governing the relationship between the Client and the Company and supersede all prior communications or representations.
21. Amendments
At Amigo Treks and Expedition Pvt. Ltd., we reserve the right to revise, update, or modify these Terms and Conditions from time to time to reflect changes in legal requirements, operational practices, government regulations, travel conditions, or Company policies.

21.4 No Waiver of Rights
Failure by the Company to enforce any provision of these Terms and Conditions at any time shall not constitute a waiver of the Company’s right to subsequently enforce such provision or any other part of the agreement.
By booking or participating in any Trip organized by Amigo Treks and Expedition Pvt. Ltd., the Client acknowledges and agrees that the Company may update these Terms and Conditions from time to time and that reasonable notice may be provided through official communication channels or website publication.
